Elements of a Violation - Before you check the box that a facility or person is in noncompliance, do you know all the required elements for that finding?  This class focuses on determining compliance with laws, regulations and permits, including possible hidden requirements such as statutes of limitation, intent, knowledge and /or actual damages requirements.

Evidence of a Violation - To make the finding that a facility or person is in noncompliance, you must have evidence to support each element of the violation. This presentation offers suggestions as to where to find evidence including your site visit, your files, other government records, and the internet. Topics also include identifying various business organizations, property ownership, how to handle evidence, chain of custody, and what is required to be able to use your evidence in formal proceedings.

Making Your Case - It starts with preparing for your inspection, documenting your observations, what to look for, dealing with efforts to avoid detection, tools to get more information, enforcement options, then presenting your case (to your supervisor, the violator, a prosecutor). This is not a course on presenting a case at hearing or trail, it’s a course on how to get to that point.
